Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 925

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Guardianship of a female who has reached seven years—in Hanbali jurisprudence—belongs to her father. The reason: he is better able to protect her and more entitled to her guardianship than others, and because her hand in marriage is sought from him and he is more knowledgeable about suitability, he takes precedence over others; she is therefore not given a choice, no valid analogy may be drawn between her and a boy, and no valid analogy may be drawn between the period after seven and the period before it.
