Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1390

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The time limit for bringing an administrative action is a matter of public order. The court must observe it of its own motion, ascertain the grounds interrupting the time limit, and assess the administrative authority’s conduct in relation to them and whether it was affirmative conduct extending the time limit for bringing the action, or negate that, so long as its factual elements are before it.
