The binding authority of judgments. Its restriction to the parties to the litigation in which they are rendered. It does not extend to outsiders. The reason: application of the rule of the relative effect of judgments. Example: the court’s omission to respond to a non-essential defence that would not change the view taken in the action.

حجية الأحكام. قصرها على أطراف الخصومة فيها. لا تتعداها إلى الخارجين عنها. علة ذلك: إعمالاً لقاعدة نسبة الأحكام. مثال: لإغفال المحكمة الرد على دفاع غير جوهري لا يترتب عليه تغيير الرأي في الدعوى.Original Arabic judgment citations
