Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1483

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court of merits has authority to ascertain and understand the facts of the case, assess the evidence, documents, and defences, and adopt those it finds convincing. It suffices that it base its ruling on reasonable grounds. It is not obliged to follow the litigants through every aspect of their defences so long as it states the truth of which it is convinced and sets out its evidence as an implicit rebuttal disposing of everything else. An example of a reasonable inference by the judgment and its foundation on correct grounds in explaining the appellant's relationship with the Public Authority for Applied Education and the benefits to which he is entitled by virtue of his work in a position within the general cadre. - Failure to respond to a defence that is manifestly invalid or unsound:-
