Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1689

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An employee’s claim to an acquired right to work in a particular place or a particular position, by appointment or secondment. Impermissible. The reason: the administration’s power to transfer him from one position to an equivalent one in pursuit of the public interest, unless it appears that the administration thereby intended to punish him or misused its power and exceeded its authority to organize and properly administer the public service. - Not everything issued by the administration that may diminish an employee’s benefits necessarily constitutes a disciplinary decision. - The contemporaneous issuance of a decision transferring an employee and a decision penalizing him, or their succession. Does not suffice to establish the defect of abuse or misuse of power.
