An administrative decision is not invalidated by a formal defect. Exception. Where the law prescribes nullity upon omission of the procedure, or where the procedure is essential and its omission results in forfeiture of an interest the legislature intended to secure. Achievement of the purpose of the procedure precludes reliance on nullity. - The administrative authority may correct its decision affected by a formal defect. Its condition. This must not affect the substance of the decision, and the grounds necessitating its issuance must remain in existence. - Decisions of councils and committees. The general rule is their issuance at a meeting after discussion and scrutiny in a session having the legally required quorum. Their approval may be obtained by circulation to members individually in urgent cases, and the decision is issued if its substance is unanimously agreed upon by all members. An example concerning a decision of the General Scholarships Committee, by circulation, withdrawing a scholarship.
