Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 294

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Administrative decisions contrary to the law require the administrative authority to withdraw them in order to remove their violation of the principle of legality and avoid a judicial ruling annulling them. Condition thereof: withdrawal must occur within one year from the date the decision was issued. Reason therefor: reconciling the administration's right to remedy the violation of law in its decision with the duty to preserve the stability of the legal situations and positions resulting therefrom. - The court of merits has authority to understand the acts and decisions issued by the administrative authority and give them their factual legal characterisation, provided that it bases its ruling on sound reasons. Example.
