Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 304

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An annulment action. Is an objective action whose subject matter is the challenge to an administrative decision. - The first-instance court's ruling that the administrative decision has become immune because no annulment action was brought within the time limit, on the basis that it was not legally non-existent. Exhausts its jurisdiction to determine the dispute. The reason therefor: it is an implicit ruling rejecting the request for annulment. - The adjudication in a judgment is not its operative part alone. Part of it may appear in the reasons.
