Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 326

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The time limit for challenging administrative decisions. Sixty days from the date of publication of the challenged decision, notification thereof to the person concerned, or establishment of his certain knowledge thereof. Its interruption by an administrative grievance before bringing an annulment action and awaiting expiry of the period prescribed for deciding it. Expiry of that period without a response. Does not constitute a conclusive presumption of its rejection. It is a rebuttable presumption admitting proof to the contrary and is displaced by other presumptions inferred from the administration's own conduct. The inference precluding this assumption. What suffices to establish it. The effect of this. An example of a judgment erroneously concluding that an annulment action was inadmissible because it was brought after the time limit.
