Kuwait Court of Cassation principle number 382

The Central Bank of Kuwait is authorized to purchase the aggregate distressed debts of Kuwaiti customers with banks, investment companies, and Kuwait Finance House. The criterion therefor is that those debts were outstanding on 1/8/1990. Challenging the Central Bank’s negative decision in refraining from purchasing those debts. A challenge to an administrative decision over which the Administrative Circuit of the Court of First Instance alone has jurisdiction.
