English translation of the principle

The time limit for bringing an action to annul an administrative decision. Sixty days. This time limit is interrupted by a grievance to the authority issuing the decision or its superior authority. The time for submitting the grievance. Before this time limit expires. A complaint submitted to an authority other than this authority, such as the State Commissioner or the Legal Affairs Department of the entity to which the complainant belongs. It is not considered a grievance. What determines commencement of the time limit is its actual arrival at the competent authority. No receipt or document issued by an authority other than the competent authority is to be relied upon concerning the date of receipt of the grievance. - The passage of sixty days from the date of submission of the grievance without a response to the complainant constitutes a decision rejecting it. The complainant must bring the annulment action within sixty days from that date. Bringing the action after the prescribed time limit renders it procedurally inadmissible. - 120 - Administrative
