The court of merits has authority to ascertain and understand the facts of the action, and may interpret contracts, disputed terms, and all documents submitted to it and infer what it considers most faithful to the intention of their contracting parties, provided that its interpretation does not depart from the meaning borne by the document’s wording and does not distort it.

لمحكمة الموضوع سلطة تحصيل وفهم الواقع في الدعوى ولها تفسير العقود والشروط المختلف عليها وسائر المحررات المقدمة إليها واستخلاص ما تراه أوفى بمقصود عاقديها مادامت لم تخرج في تفسيرها عن المعنى الذي تحمله عبارات المحرر ولا تتضمن تحريفاً لها.Original Arabic judgment citations
