Kuwait Court of Cassation principle number 652
State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The meaning of a particular phrase in a contract, legal disposition or other instruments is not to be considered in isolation from the other phrases. The meaning conveyed by the wording as a whole must be adopted. The reason: it constitutes an interconnected, cohesive unit through which its true intended meaning is ascertained.
Arabic original
عدم الاعتداد بما تعنيه عبارة معينة في العقد أو التصرف القانوني أو سائر المحررات بمعزل عن غيرها من العبارات. وجوب الأخذ بما تفيده العبارات بأكملها. علة ذلك: باعتبارها وحدة مترابطة متماسكة توصلاً للتعرف على حقيقة المقصود منها.Original Arabic judgment citations
