Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1149

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Every judgment of conviction must contain the legal provision pursuant to which it was rendered. The reason for that. - The judgment's failure to mention the legal provision pursuant to which punishment was imposed on the appellant. Invalidates it. Its reference in its preamble to the articles underlying the charge. Is insufficient so long as it does not expressly state that it adopted them or refer to the first-instance judgment in this regard.
