Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1481

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The judgment's failure to elucidate the facts of the case and set out the evidence of guilt. An inadequacy of reasoning not cured by its indication that the first-instance judgment relied, in convicting the appellant, on reasons having an established basis in the papers, so long as it did not express its adoption of them and its taking them as reasons for its decision.
