Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1482

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The felony of intentional homicide is distinguished from other offences against the person by a special element: the offender's intent, in committing the act, to take the victim's life, which is a matter the offender conceals and harbours within himself. A judgment convicting the accused of this felony must take care to discuss this element separately and establish it by setting out the evidence from which the intent to take the victim's life at the time of committing the physical act was inferred. Reason therefor. Example of defective reasoning concerning the existence of intent to kill. - 419 - Criminal Procedures and Trials - The accused's preparation of a pistol, firing it at the female victim from close range and causing her injury. Insufficient to prove intent to kill so long as the judgment has not disclosed the existence of that intent within him. Reason therefor.
