Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1519

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A state of flagrante delicto. What suffices for its existence. Its assessment and inference fall within the trial court’s authority. - Assessment of the validity of a confession and its evidentiary value. A matter for the trial court. The court’s right to reject it if not persuaded of its validity and conformity with truth and reality. - The sufficiency of the court’s doubt as to the correctness of attributing the charge to the accused as a basis for acquittal. Criticizing it for so ruling on a possibility it considered more likely, on the allegation that other possibilities exist, is not valid.
Arabic original
