Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1742

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The investigating public prosecutor’s recording that there was a medical bandage on the appellant’s leg and that he leaned on a crutch. The judgment’s reliance on his confession and those of others, and its limiting its response to his plea that his confession in the Public Prosecution’s investigations was invalid because it resulted from coercion to stating that he and the others confessed in those investigations and that no evidence supported that plea, as it was subject to the court’s assessment. Inadequacy, defective inference, and contradiction of what is established in the papers invalidate it. The other evidence upon which its ruling was based does not shield it from that. The reason: the interdependence of the evidence.
