Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1904

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The time limit for appeal is a matter of public policy. It may be invoked at any stage of the proceedings. Raising any plea concerning it for the first time before the Court of Cassation. Its condition: that it be based on facts established in the judgment's reasoning and not require a factual investigation beyond the function of the Court of Cassation. - The absence from the papers of any plea by the appellant justifying his exceeding the prescribed time limit for lodging the second appeal - 521 - Criminal Procedures and Trials. Raising this before the Court of Cassation. Unfounded. This is not undermined by his complaint that the clerk erred in recording the judgment challenged when the first appeal was lodged. The reason: the appeal petition is authoritative as to the particulars recorded therein, and the notice of appeal is the criterion for determining the limits of the parts of the judgment actually appealed; the appellate court is not seized of any subject other than that submitted to it pursuant to the notice of appeal.
