Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1905

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Assessment of the excuse of illness preventing the lodging of an appeal within the time limit. A matter for the trial court, provided it is reasonable. - A lawyer’s delay in lodging an appeal against the judgment rendered against the accused is not a circumstance of force majeure. The reason: lodging an appeal is the concern of the convicted person, not his lawyer. The law does not require the accused to appoint a lawyer to appeal the judgment rendered against him. Example.
