English translation of the principle

The appeal petition. It may not be supplemented by anything outside it. - The Public Prosecution’s appeal against the first-instance judgment on grounds of proof. Its implication: it challenges the acquittal rendered by that judgment. The appellate court’s consideration of accused persons who were convicted. Impermissible. This is not altered by the Public Prosecution’s endorsement on the case file referring to something contrary to the appeal petition, or by the clerical error in the preamble to the challenged judgment in including the name of a person convicted among the respondents, provided it disclosed in its reasons that - 528 - Criminal Procedures and Trials the Public Prosecution’s appeal on grounds of proof concerns those acquitted. The Public Prosecution’s challenge to this judgment must be ruled inadmissible.
