Kuwait Court of Cassation principle number 27
State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The rule is that actions for civil rights are brought before the civil courts. The exception: bringing them before the criminal court whenever they are ancillary to the criminal action and the right claimed arises directly from a wrongful act constituting an offence that is the subject of the pending criminal action. This permission is absent where that is not fulfilled. - The basis for claiming compensation before the criminal judiciary. That it be for an act punishable by law and that the damage be personal, resulting from this act and directly causally connected with it. The feeling of wounded national pride and of what befell the people of Kuwait and their property that arose from the offence. May not be asserted as a civil claim before the criminal court. The reason for this. Compensation here is contingent upon imposing punishment on the perpetrator of the act. The consequence: the criminal courts lack jurisdiction to hear the ancillary civil action. Its relation to public policy requires the court to rule on it of its own motion. - The challenged judgment's ruling that the civil claim is inadmissible reaches the same result as a ruling that the criminal judiciary lacks jurisdiction to hear it, and the ground of appeal is ineffectual and yields only a purely theoretical interest, requiring dismissal of the appeal.
Arabic original
Original Arabic judgment citations
