Kuwait Court of Cassation principle number 30
State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The jurisdiction of the Felony Court over misdemeanours connected with felonies. Its implication: its jurisdiction over the facts submitted to it by the prosecuting authority as a felony which, after examining them, it considers to constitute a misdemeanour. The basis and reason for this: the requirements of justice dictate that the court proceed to hear the case after having made considerable progress in discussing its elements and become better able than others to adjudicate its merits, and to avert any conflicts of jurisdiction that might arise between it and the Misdemeanour Court; and the determining factor for jurisdiction is the legal characterisation of the facts under which the action was brought.
Arabic original
Original Arabic judgment citations
