Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 556

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A confession relied upon must be voluntary. It is not so, even if truthful, if it results from coercion, whatever its degree. - A plea that a confession is invalid because it was made under the influence of coercion. Substantial. It must be addressed - 240 - Criminal Procedures and Trials by the court, by stating and answering it, insofar as it relied upon it for conviction. Omitting this and dismissing the plea on the basis of the prosecution evidence without negating the occurrence of coercion. Prejudges the plea before it is resolved. Vitiates the judgment by deficient reasoning and unsound inference, rendering it invalid. The other evidence on which it relied does not save it. Basis thereof.
