Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 557

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Giving weight to and relying upon a confession. Legally valid only if it is valid and given freely and voluntarily. It is not considered such, even if true, if it results from procedures that are not valid or lawful. The evidence derived from it must be excluded. - The plea of invalidity of a confession because it was made following, and influenced by, invalid investigation and interrogation procedures. Substantial. Requires the court to address and respond to it so long as it relied on the evidence derived from it. The other evidence cited by the court does not dispense with this. Reason therefor: the interdependence of evidence in criminal matters. Example.
Arabic original
