Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 587

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Evidence admissible to prove the offense stipulated in Article 194 of the Penal Code: apprehending the perpetrator in flagrante delicto committing the offense of sexual intercourse with a woman who has reached twenty-one with her consent. The accused's confession against himself dispenses with deception. - Availability of the accused's confession against himself. The court may rely upon it and adopt it whenever satisfied of its validity, even if he was not apprehended in flagrante delicto. Reason for that: confession is the master of evidence. The challenged judgment's contravention of that. An error in applying the law. Requires its cassation for the appellants, but not for anyone who was not a party to the proceedings. - The restriction on proving the offense of sexual intercourse. Encompasses it in all its characterizations, whether a completed offense or merely an attempt.
