Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 785

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Basing a judgment on something having no basis in the case papers renders it defective. The judgment's reliance on other evidence does not suffice, since evidence in criminal matters is mutually supporting. An example of the collapse of one of the mutually supporting items of evidence, the resulting defect in the judgment, and an effect of this.
