Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 841

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Appeal by way of cassation in criminal matters. A personal right of the convicted person, exercised by him personally or through another whom he authorizes by a general or special power of attorney permitting the exercise of this right. A subsequent power of attorney does not suffice. The reason for that: what matters is the existence of the agent's capacity at the time the appeal is lodged. An example.
