English translation of the principle

The registry department of the appellate court must notify the accused and all other parties of the date of the hearing fixed to consider the appeal, and it must be ascertained, before the court decides the case in the accused's absence, that he has been validly served to attend the specified hearing. - Delivery of the notice of service for an imprisoned accused shall be to the prison director or whoever acts in his stead. - 317 - Criminal Procedures and Trials - Proof that the notice of service for the imprisoned accused was delivered to the Public Prosecution because he could not be located. Its effect: he has not been validly served. The appellate court must adjourn his trial to a subsequent hearing of which he is to be notified. Omitting this and adjudicating the appeal brought by the Public Prosecution on the basis of this service. Vitiates the judgment and requires its cassation.
