Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1030

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An order for restitution was not prescribed for punishment or deterrence, but was intended to restore the situation to what it was before the offence was committed. Ordering it depends upon its basis, namely that the property remains owed by the offender who embezzled or appropriated it. The judgment ordering the appellant to return the appropriated property despite its seizure. An error in applying the law.
