State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A police officer's search of the accused for narcotic substances pursuant to an order issued to him by the competent authority. Permits him to conduct the search in every place where he considers the narcotic might be found and what follows therefrom by any method he considers conducive to that end. His incidental detection, during that search, of the offence of possessing firearms and ammunition without a deliberate endeavour on his part. An offence in flagrante delicto, and it is his duty to seize what that search disclosed. Proceeding with the procedures concerning it and submitting it to the competent authority. Valid. The challenge on this ground. A manifestly unfounded legal defence which the court is not at fault for disregarding.
