Kuwait Court of Cassation principle number 1309

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Absence of liability. Its criterion: that the perpetrator, at the time of committing the offence, lacked freedom of choice as a result of a threat to harm his person or property. - States of agitation, provocation or anger are not forms of threat resulting in loss of freedom of choice. The appellant’s complaint in this regard does not affect the establishment of his criminal liability.
