Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 136

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Lawful defence was instituted to prevent an act of aggression against the person of the defender or another person, or its continuation, and was not instituted to punish the aggressor or for revenge. Example of sound reasoning for the absence of a state of lawful defence in an incident of a brawl.
Arabic original
