State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Offences inseparably connected and committed for a single purpose. Their perpetrator is punished with the punishment prescribed for the most serious of them. Article 84 of the Penal Code. - The Unified Customs Law’s prescribing a principal punishment for customs smuggling, acts deemed equivalent thereto, and an attempt at either, after they had carried a supplementary punishment under the repealed decree. Article 145 of Law 10/2003 promulgating the Unified Customs Law. Its implication: only the punishment for the most serious offence (importing narcotics with intent to use) must be imposed. The judgment’s contravening this and imposing a customs fine for the offence of customs smuggling. A violation of the law giving the Public Prosecution an interest in challenging it and requiring partial cassation of the judgment and its correction by cancelling that fine.
