Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 223

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Attempt to commit an offence. Established by commencing execution of an act immediately preceding execution of the material element of the offence and inevitably leading to it. - The judgment’s considering that the acts committed by the respondent constitute the offence of attempted detention of the female victim, although what it gathered from the investigations conclusively indicated that his intent was directed towards kidnapping her. Vitiates it through defective inference which led it into an error in applying the law, requiring its cassation. Example.
