Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 419

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Examination of whether the perpetrator possessed the intent to kill and premeditation or lacked them. A matter of fact, provided it is sound. - The perpetrator’s stabbing the victim with a knife. Does not in itself indicate his intention to kill him and take his life, or necessarily imply that, unless this intention existed in his mind or was revealed by the external signs and manifestations indicating it. - The court’s inference, through sound reasoning, that the respondent did not intend to kill the victim or take his life, but merely to repel the assault he had initiated. Constitutes a determination of a factual issue. The Court of Cassation has no supervisory authority over it. Disputing this. A factual argument. Inadmissible before the Court of Cassation.
