Kuwait Court of Cassation principle number 526
State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The offense of kidnapping by force or threat provided for in Article 178 of the Penal Code. Established by removing the victim from the place from which he was kidnapped through force, threat, or deception. - Criminal intent in this offense. Established by the offender's deliberately seizing the victim and removing him from the place from which he was kidnapped, whatever the offender's purpose therein. - An attempt to commit the offense. Established by commencing execution of an act immediately preceding execution of the material element of the offense and inevitably leading to it. - The judgment's finding that the acts committed by the respondent constitute the offense of attempted detention of the female victim, although what it gathered from the investigations conclusively indicates that his intent was directed toward kidnapping her. Vitiates it through defective inference that led it to error in applying the law, requiring its cassation. Example.
Arabic original
Original Arabic judgment citations
