The spouse's right in the offence of adultery. Preventing the institution of criminal proceedings against the adulterous spouse, staying the course of trial proceedings at whatever stage the case has reached, and staying execution of the final judgment. The reason therefor: shielding honour and preserving the rights of children. The import thereof: waiver prevents the judiciary from examining the act of the adulterous spouse under any characterization, whether as a principal or an accomplice, or what the other adulterous spouse committed against their absent spouse, so long as the two offences arose from a single act.
