State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The offence of theft. Its completion: by taking possession of the stolen thing so as to remove it from its owner's possession and place it in the thief's grasp and at his disposal. Criminal intent therein. Established by the perpetrator's knowledge at the time of committing the act that he is taking property belonging to another without its owner's consent, intending to appropriate it. The judgment addressing it expressly and separately. Unnecessary, so long as what it states sufficiently indicates its existence. The challenge in this regard. Without basis. - The appellant's reliance on the absence of fingerprint traces or bloodstains on the seized knife. Does not negate the commission of the offence or its attribution to him. Disputing this. A factual argument. Raising it before the Court of Cassation. Inadmissible. - 195 - Penal Law
