Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 697

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Theft is among the offences for which the law requires a specific intent, namely the intent to steal. - Although the adequacy of the reasoning of a judgment of conviction does not require it to address the intent to steal separately, if that intent is in doubt or the offender disputes its existence, the judgment must expressly establish that intent and set out the evidence of its existence. Otherwise, it is deficient.
