Kuwait Court of Cassation principle number 78

Article 36 of Law 31/1970 includes a provision punishing an official's taking a bribe after improperly performing or refraining from an act, as a reward and with the intention of a prior agreement. A special provision which does not imply the repeal or amendment of the general rule in Article 118/1 of the Penal Code criminalizing acceptance of a bribe after rightfully performing or refraining from an act and without prior agreement, and does not conflict with it.
