State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The term contract applies to every agreement intended to produce a legal effect. - Consensual contracts are completed and concluded merely by the concurrence of offer and acceptance. The subject matter of the obligation need not be determined. It suffices that it be determinable according to the nature of the obligation and the circumstances surrounding the contracting. - Failure to state the cause of the obligation in the contract does not result in its nonexistence. - The existence of the contract and determination of its subject matter and cause. This results in its barring either party from having recourse against the other through an unjust enrichment action.
