State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Expression of intention. It exists upon its issuance by its author. When it takes effect: when it comes to the knowledge of the person to whom it is addressed. - The principal's exemption of the agent from performing his obligation to render an account of his agency activities. A legal act in which the principal expresses his intention, even implicitly. Its operation throughout the term of the agency and after its termination. - The principal's illness, even if severe. It is not a legal ground for termination of the agency. The effect of the exemption from the agent's rendering an account of the agency activities continues under the presumption of continuity of the existing state. Incidental, temporary loss of capacity by either party to the contract. The agency does not terminate thereby. Regard is had to permanent loss by which legal positions become settled. Assessment thereof. A matter of fact.
