Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1350

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A contract for the sale of a commercial establishment containing no statement of the business's tangible and intangible elements. Does not in itself indicate that the sale does not include them. For the contract to be regarded as a contract for the sale of a business, the property sold need not contain all the business's tangible and intangible elements; it suffices that it contain those that are essential according to the type of activity. Example.
