Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1426

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Duress invalidating consent. It arises only through threatening the coerced contracting party with grave, imminent danger to his person or property, or through the use of other means of pressure that he cannot withstand or escape. - The appellant's contention that its representative was subjected to means of pressure that drove him to sign the disputed discharge to avert the administrative authority's threat not to pay the amounts due included in the final payment certificate. This does not constitute duress entailing the invalidity of the disposition. The reason for this. The possibility of escaping such pressure by judicially claiming the amounts due in full, together with compensation if warranted. Example.
