Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1458

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Fraudulent inducement, its nature: the use of fraudulent methods capable of inducing a contracting party to conclude the juridical act to which his will was directed, thereby vitiating it. Obtaining a person's signature on an instrument that his will was never directed to executing, however, constitutes forgery in which that will is absent, even if the signature was obtained through fraudulent methods.
