Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1522

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

What is required for mistake to have effect in a contract. It must be the inducement to contract, such that without it the contract would not have been consented to, and the mistake must be connected with the other contracting party. - Mistake has no effect on the validity of the contract if it was not an inducement to contract. What matters is not the subject of the mistake but its effect on consent to the contract.
