Characterisation of contracts. Its criterion: the common purpose towards which the contracting parties' intention was directed at the time of concluding the contract. Identification of this purpose. Within the authority of the court of merits, without further review, provided that it traces it to indications and grounds that rationally lead to it, do not contradict what is established in the papers and do not depart from the apparent meaning of the terms of the contract. تكييف العقود. مناطه: بالقصد المشترك الذي انصرفت إليه نية العاقدين وقت إبرام العقد. التعرف على هذا القصد. من سلطة محكمة الموضوع بلا معقب متى ردته إلى شواهد وأسانيد تؤدي إليه عقلاً ولا مخالفة فيها للثابت بالأوراق ولا خروج فيها على المعنى الظاهر لعبارات العقد. تفسير العقد:Original Arabic judgment citations
