Kuwait Court of Cassation principle number 1952

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Interpreting agreements and instruments to ascertain their true intended meaning. Within the trial court’s authority, unless the interpretation departs from what the wording of the instruments admits or distorts their true meaning. - A court may depart from the apparent meaning of the wording of instruments, but it must state the reasons leading it to conclude that the meaning it adopted is the intended one; otherwise, its judgment is defective.
