English translation of the principle
Interpreting contracts and instruments. Within the authority of the court of merits. Its condition. It must not depart from what the instrument's expressions can bear or distort their true meaning. It must draw assistance in doing so from the facts and circumstances of the action, without stopping at the literal meaning of its expressions or words, or some of them to the exclusion of others. In doing so, it is subject to review by the Court of Cassation.

تفسير العقود والمحررا ت. من سلطة محكمة الموضوع. شرطه. ألاّ تخرج عما تحتمله عبارات المحرر أو تشوه حقيقة معناها. وجوب الاستعانة في ذلك بوقائع الدعوى وظروفها ودون الوقوف عند المعنى الحرفي لعباراته أو ألفاظه أو بعضاً منها دون الآخر. خضوعها في ذلك لرقابة محكمة التمييز.Original Arabic judgment citations
